Governing use of the TraderStudy software, portal, and subscription services

1. Acceptance of These Terms
These Terms and Conditions ("Terms") form a binding agreement between you ("Client", "User", "you") and TraderStudy, operating the TraderStudy.com platform ("TraderStudy", "the Company", "we", "us"). By creating an account, accessing the client portal, downloading or activating the TraderStudy Expert Advisor ("EA", "the Software"), or completing a purchase on https://www.traderstudy.com, you confirm that you have read, understood, and agree to be bound by these Terms, the Risk Warning, and the Privacy Policy, each of which is incorporated by reference.
If you do not agree with any part of these Terms, you must not register for, access, or use the Software or any related service. These Terms apply to all visitors, registered users, portal subscribers, and purchasers, regardless of country of residence.
2. Definitions
- "Software" / "EA" — the TraderStudy automated trading algorithm (Expert Advisor) designed to operate on the MetaTrader 5 ("MT5") platform.
- "Portal" — the TraderStudy client dashboard used to view performance reports, manage subscriptions, and access support and setup materials.
- "Broker" — the independent, third-party regulated brokerage firm chosen and engaged directly by the Client, where the Client's trading account and funds are held.
- "Trading Account" — the MT5 account opened and controlled solely by the Client at their chosen Broker, whether demo or live.
- "Subscription" / "Access Plan" — any paid access period granting the Client a licence to activate and use the Software, including the initial access period and any optional monthly or annual continued-access plan described in Section 7.
- "Payment Processor" — any independent third-party payment processor, merchant of record, card-network-connected provider, or other payment service selected by us from time to time to process payments, refunds, or related billing functions on our behalf.
3. Nature of Our Service — Technology Provider Only
TraderStudy is a software technology company. We are not a broker-dealer, bank, investment adviser, portfolio manager, asset manager, or provider of trading signals. We do not accept deposits, hold client funds or securities, execute trades on your behalf as principal or agent, or manage discretionary accounts of any kind.
We license automated trading software that you install and run on a Trading Account that you independently open, fund, and control at a Broker of your own choosing. All trades placed by the Software are executed through your Broker's trading infrastructure, using your own capital, under settings that you configure and remain free to change or disable at any time. We have no access to, custody of, or control over your funds at any time.
You are solely responsible for selecting a Broker that is appropriately licensed and regulated in your jurisdiction, for reviewing that Broker's own terms, fees, execution policies, and for ensuring your use of automated trading software complies with your Broker's rules and with the laws applicable to you.
Broker and Platform Independence. TraderStudy is an independent software provider and is not owned by, operated by, endorsed by, sponsored by, or affiliated with MetaQuotes, MetaTrader, or any Broker, trading venue, liquidity provider, or financial institution mentioned or compatible with the Service, unless we expressly state otherwise in writing. References to MT5, broker names, platform names, or third-party trademarks are for identification and compatibility purposes only. All such trademarks and service marks remain the property of their respective owners.
4. Eligibility
- You must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) to register for or purchase access to the Service.
- You represent that you have the legal capacity to enter into a binding contract and, where trading with live funds, that you are trading with risk capital you can afford to lose in full (see the Risk Warning).
- You represent that your use of the Software does not violate any law, regulation, or third-party agreement (including your Broker's terms) applicable to you in your country of residence, including but not limited to Brazil, Mexico, and Colombia.
- We reserve the right to refuse service, suspend, or terminate accounts of Clients located in jurisdictions where distribution of the Software would be unlawful or where we determine, in our reasonable discretion, that offering the Service would create undue regulatory risk.
5. Description of the Product
The Software is a rules-based automated trading algorithm intended for use on the MT5 platform, configured by default to operate on Gold/XAUUSD and the S&P 500 index (or related instruments made available by your Broker). Functionality, supported instruments, default risk parameters, and system requirements may be updated from time to time and are described in the Portal and installation documentation.
The Software does not guarantee access to any specific Broker, execution venue, or instrument. Availability of a given instrument, spread, leverage, or execution speed is determined exclusively by your Broker and is outside our control.
6. Free Demo Period and Onboarding
New Clients are encouraged to test the Software on a demo (paper-money) MT5 account before connecting it to a live Trading Account. Demo-account results are simulated, do not involve real funds, and are provided solely for evaluation and familiarization purposes.
Demo account performance is not representative of, and should never be relied upon as a predictor of, live trading results. Live markets involve execution factors — including slippage, requotes, latency, spread widening, liquidity gaps, and broker-specific order handling — that are not fully replicated in a demo environment.
7. Access Plans, Pricing, and Billing

Access begins with a one-time charge of $29 USD for the first three (3) months. This initial access period does not automatically convert into a monthly or annual plan. At the end of the initial access period, access will expire unless you affirmatively contact or otherwise request continued access and complete a separate purchase for an available monthly or annual plan. We will not automatically enroll you in continued access, automatically renew your access, or charge your payment method for a later access period without your separate affirmative request and purchase. All prices are quoted in U.S. Dollars and exclude any taxes, duties, or currency-conversion fees that may be applied by your card issuer or payment provider.
7.1 No Automatic Renewal or Conversion
There is no automatic renewal or automatic conversion from the initial access period into a paid monthly or annual plan. If you wish to continue using the Software after your current access period ends, you must affirmatively request or select an available continued-access plan and complete a new purchase. Unless a future offer expressly states otherwise and you separately agree to it before purchase, each monthly or annual access plan expires at the end of the purchased term without automatic renewal.
7.2 Pricing for Optional Continued Access
Pricing for optional monthly or annual continued access may change from time to time. The applicable price, access term, and material billing terms will be presented or confirmed before you complete each purchase. A price shown for a prior access period does not guarantee the same price for a later purchase.
8. Payment Processing
Payments may be processed by independent third-party payment processors selected by us from time to time. Those providers may have their own terms, privacy notices, security practices, and card-network requirements. We do not commit in these Terms to using any specific payment processor. Where payment details are collected directly by a third-party payment processor, we do not store the full card number on our own systems. By submitting payment details for a purchase, you authorize us and the applicable payment processor to charge only the amount and access term that you affirmatively select or approve at that time. No later monthly or annual access charge will be made automatically unless you separately agree to such billing in a future offer.
- Merchant of record and billing descriptor will be clearly disclosed at checkout so charges are recognizable on your statement.
- Failed or declined payments may result in suspension of Portal or EA access until payment is resolved.
- Chargebacks and payment disputes should first be raised with our support team; we cooperate with payment processors and card issuers in good faith to resolve billing disputes and will provide documentation of the transaction, disclosures, and usage on request.
- We reserve the right to suspend accounts with a pattern of unresolved disputes or suspected payment fraud, pending investigation.
9. 30-Day Money-Back Guarantee
We offer a 30-day money-back guarantee on the initial $29 access purchase. If you are not satisfied within 30 calendar days of your original purchase date, contact support to request a refund of that initial payment.
- The guarantee applies once per Client / household / payment method, and only to the Client's first $29 initial access purchase.
- Refund requests must be submitted within 30 calendar days of the original purchase date via the Portal or by emailing [support@TraderStudy.com].
- Approved refunds are returned to the original payment method within a commercially reasonable time and in accordance with the applicable payment processor and card-network processing timelines.
- The guarantee covers the price paid for the Subscription itself. It does not cover, and we are not responsible for, trading losses, Broker fees, VPS costs, or third-party charges incurred while using the Software.
- The guarantee does not automatically apply to later monthly or annual continued-access purchases unless expressly stated at the time of purchase or required by applicable law. It also does not apply where we reasonably determine the request is fraudulent, abusive, or made after materially breaching these Terms (e.g., unauthorized redistribution of the Software).
10. Cancellation and Termination
Your initial access and any optional monthly or annual continued-access plan are purchased for a defined access period and do not automatically renew under these Terms. You may stop using the Service at any time, but the purchased access period will ordinarily remain available until its stated expiry date. Because there is no automatic renewal, no future access charge is scheduled unless you affirmatively request and purchase another access period. No partial-period or pro-rata refunds are issued for unused time, except where required by law or as expressly stated in Section 9.
We may suspend or terminate your access immediately, without refund of amounts already billed, if you breach these Terms, misuse the Software, engage in fraudulent or abusive conduct, attempt to redistribute or reverse-engineer the Software, or use the Service in a manner that exposes us to legal or regulatory risk.
11. Licence Grant and Restrictions
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and run one (1) copy of the Software on Trading Account(s) that you control, for your own personal or internal business use, for the duration of the access period you have purchased.
- You may not copy, sublicense, sell, rent, lease, lend, or otherwise distribute the Software or your licence key to any third party.
- You may not reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying logic of the Software.
- You may not use the Software to provide managed-account, signal-copying, or white-label services to third parties without our prior written consent.
- You may not remove, obscure, or alter any proprietary notices contained in the Software or Portal.
- Licence keys are personal to your account and may be deactivated if shared or used in violation of these Terms.
12. Your Responsibilities
- You are solely responsible for opening, funding, and maintaining your own Trading Account with a Broker of your choice, and for that Broker's fees, spreads, margin calls, and execution.
- You are solely responsible for configuring risk parameters (lot size, stop-loss, take-profit, maximum drawdown limits, etc.) appropriate to your own risk tolerance and account size.
- You are responsible for maintaining a stable installation environment (e.g., VPS or always-on computer), a reliable internet connection, and keeping your MT5 platform and the Software up to date.
- You are responsible for monitoring your Trading Account and the Software's activity on an ongoing basis; the Software is not a "set and forget" system and unattended operation is at your own risk.
- You must keep your login credentials, API/licence keys, and payment details confidential and notify us promptly of any suspected unauthorized use of your account.
13. No Investment Advice, Signals, or Portfolio Management
Nothing provided by TraderStudy — including the Software, Portal content, performance reports, marketing materials, or communications from our team — constitutes investment advice, a personal recommendation, a solicitation to trade, or an offer to manage your funds. We do not assess the suitability of the Software for your individual financial situation.
Any educational or explanatory content we provide about trading concepts, strategy logic, or risk management is for general informational purposes only. You should independently evaluate, and if appropriate consult a licensed financial advisor regarding, the suitability of algorithmic trading for your circumstances before connecting the Software to a live Trading Account.
14. Performance Information and No Guaranteed Returns
Any performance figures, charts, backtests, or statistics displayed on the website or in the Portal are provided for illustrative and informational purposes only. Past performance — whether from live accounts, demo accounts, or backtests — is not indicative of, and does not guarantee, future results.
- We do not represent, warrant, promise, or guarantee any specific level of profit, rate of return, or freedom from loss.
- Backtested or simulated results have inherent limitations, including the benefit of hindsight, and may not reflect the impact of real market conditions such as slippage or liquidity constraints.
- Verified results shown may be based on selected accounts, time periods, or market conditions and may not be representative of every Client's experience.
15. Prohibited Uses
- Using the Software for market manipulation, wash trading, or any activity prohibited by your Broker's terms or by applicable securities/commodities law.
- Using the Service to launder money or to process funds derived from unlawful activity.
- Circumventing licence restrictions, usage limits, or geographic/regulatory access controls.
- Misrepresenting your identity, providing false KYC/payment information, or impersonating another person or entity.
- Using the Software in a jurisdiction where its use, or the underlying instruments (e.g., leveraged FX/CFD-style products), are prohibited or unlicensed for retail distribution.
16. Intellectual Property
All rights, title, and interest in and to the Software, Portal, website, algorithms, documentation, trademarks (including the TraderStudy name and logo), and all related content are and remain the exclusive property of [COMPANY LEGAL NAME], operating the TraderStudy platform ("TraderStudy", "the Company", "we", "us") or its licensors. Except for the limited licence granted in Section 11, no rights are transferred to you.
17. Third-Party Services
The Service interoperates with third-party platforms and providers we do not own or control, including the MetaTrader 5 platform, your Broker, payment processors, CRM/email providers, hosting providers, and VPS providers you may separately engage. TraderStudy is independent of these third parties and does not endorse, control, or guarantee their services unless expressly stated otherwise. We are not responsible for their acts, omissions, outages, policy changes, fees, execution quality, or business continuity. Your relationship with each third party is governed by that party's own terms and policies.
18. Advertising, Marketing, and Platform-Compliance Commitments
Our marketing across advertising platforms, including Meta (Facebook/Instagram) and Google, is intended to comply with those platforms' financial-products advertising policies. In line with those policies and applicable consumer-protection rules:
- We do not advertise or imply guaranteed, risk-free, or "sure thing" returns.
- Performance claims are accompanied by risk warnings and past-performance disclaimers as required by advertising platform policy.
- We identify ourselves as a software/technology provider and do not represent ourselves as a licensed broker, bank, or investment adviser in advertising creative.
- Where a jurisdiction requires specific licensing, authorization, or disclosure for financial-services advertising, we tailor or restrict campaigns to comply, or refrain from advertising in that jurisdiction.
If you believe any marketing communication from us is inconsistent with these commitments, please notify us at [legal@TraderStudy.com] so we can review and correct it.
19. Data Protection
Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service, you also agree to the Privacy Policy.
20. Disclaimers of Warranties
THE SOFTWARE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, OR ACCURACY. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE PROFITABLE, ERROR-FREE, OR FREE FROM INTERRUPTION, OR THAT IT WILL MEET YOUR REQUIREMENTS.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY TRADING LOSSES, LOST PROFITS, LOSS OF DATA, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SOFTWARE OR SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law, including, where applicable, liability for gross negligence, willful misconduct, or fraud.
22. Indemnification
You agree to indemnify and hold harmless the Company and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Software, your violation of any law or third-party right, or trading activity conducted on your Trading Account.
23. Force Majeure
We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including internet or power outages, broker or exchange outages, acts of government, natural disasters, war, or widespread market disruption.
24. Changes to the Service and These Terms
We may modify, suspend, or discontinue any part of the Service, and may update these Terms from time to time. Material changes will be notified via the Portal or by email, and continued use of the Service after the effective date of an update constitutes acceptance of the revised Terms.
25. Miscellaneous
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
- Entire Agreement: These Terms, together with the Risk Warning and Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.
- Assignment: You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
- No Waiver: Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.
